An initial reservation may be made by telephone or e-mail and will be held open for 7 days only.
The booking form must be completed by the party leader, who must be 21 years or over, and submitted with the deposit.
Confirmation of the booking will be issued on receipt of the completed booking form and deposit.
Payment of the deposit confirms the acceptance of the terms and conditions set out and shall be binding on the person(s) making the booking.
Receipt of the deposit fully guarantees the villa rental price.
The price per week is for the villa, not per person.
A non-refundable villa rental deposit of £200 (or US Dollar equivalent) per booking is due within 7 days of the initial reservation together with the completed booking form.
Payment of the balance is due 10 weeks prior to the arrival date. On receipt of the final payment booking details will be issued which will include directions, key codes and Management Company details.
Payment to be made by cheque or credit card.
The rental price includes electricity, water, air conditioning, refuse collection, cable TV, local telephone calls, linen and towels and all Florida State taxes. The villa will be professionally cleaned prior to and after the rental period. The pool and gardens are maintained on routine service contracts.
If pool heating is required (recommended Oct-April) this should be requested and paid for at the time of the booking (£90 per week - or US Dollar equivalent).
A travel cot, stroller, high chair and safety deposit box are provided for guests free of charge.
A refundable £200 (or US Dollar equivalent) security deposit is to be paid at the time of final payment. The security deposit will be returned within 14 days after the day of departure unless deductions have to be made for any damages, breakages or additional cleaning costs incurred during the rental period.
During the rental period the guest is held solely responsible for any damage or breakages that may be caused to the property or its contents and also for all items in the inventory. Any additional cleaning costs for spillages or stains or any mis-use causing damages will be debited from the security deposit.
Any breakages or damage must be reported to the Management Company prior to departure to avoid being mistakenly charged.
The Owner reserves the right to pursue recompense for any and all damages that may exceed the security deposit within 14 days of being served notice of this, including taking legal action if necessary.
The maximum occupancy is 12 and all guests must be listed on the booking form.
No all male parties or parties of guests all under the age of 21 will be accepted.
No pets are allowed.
For the comfort of other guests no smoking is allowed inside the villa.
The villa will be available for occupation from 4.00pm (local time) on the day of arrival.
Check-out time is 10:00am (local time) on the day of departure unless previously agreed with the Management Company or Owner.
In the event that the booking needs to be cancelled the person making the booking must provide notification of the cancellation (to include written confirmation) to the Owner.
On receipt of notification the booking will be cancelled.
The following cancellation charges will apply:
Cancellation more than 10 weeks prior to arrival - loss of deposit.
Cancellation less than 10 weeks prior to arrival - loss of 100% of all monies paid.
In the unlikely event that circumstances beyond the Owners control necessitate cancellation of the booking the Owner will refund all monies paid to date (without interest, compensation or consequential loss of any kind).
Guests are personally responsible for the provision of travel insurance, health and visa documents.
It is strongly recommended that adequate travel insurance is purchased for all members of the party to cover eventualities such as cancellation and accidental damage.
Cancellation due to incorrect or missing travel documents will be charged at the relevant cancellation fee.
It is the responsibility of the party leader to ensure that all the members of the party adhere to these terms and conditions. Failure to abide by any of these rules could result in deductions being made from the security deposit.
It is the responsibility of the Guests to ensure that the villa is left in an orderly state and the kitchen utensils are cleaned before leaving. The Management Company will charge for extra cleaning and this will be deducted from the security deposit.
The Owner and agents accept no responsibility whatsoever for personal injury, accidents, death, loss or damage to personal belongings, however caused, as a result of use of the villa or pool. All use of appliances, equipment, pool and spa are at the users risk. It is the responsibility of an adult member of the party to ensure that children are always properly supervised, especially in and around the pool and children's play area.
The Owner cannot guarantee that all the facilities or attractions described will be available.
Whilst all information supplied is deemed to be accurate to the best of the Owners knowledge the information supplied is for guidance purposes only and could change from time to time and does not form part of any contract.
Due to the variability of the sub-tropical weather in Florida the Owner cannot guarantee the water temperature of the pool or spa. The pool and spa heaters are set and locked to standard water temperatures and to operate during the normal day in accordance with the manufacturers operating requirements. The actual water temperature will vary depending on the time of day, ambient temperature and weather conditions. Guests booking pool and spa heating do so at their own risk. The Owner will not enter into any discussions concerning complaints regarding pool or spa water temperature.
The Owner and their agents shall not be liable, jointly or individually, for any changes, cancellations, loss or damages caused by events beyond the reasonable control of either the Owner or its agents ("force majeure").
For example, force majeure includes, but is not limited to, fire, flood, weather conditions, strikes, airport closure.
The villa is registered with the Florida State Tourist Authorities and fully complies with all relevant legislation.
It is recommended that you communicate any complaint to the Management Company immediately so that the problem can be resolved at the earliest opportunity. If the complaint is not resolved locally the owners should be contacted in writing within a reasonable period of time after the rental period (within 28 days). The Owner cannot accept any responsibility for any problems that have not been reported to the Management Company.
This contract is subject to and shall be construed in accordance with the laws of England and the parties hereby submit to the exclusive jurisdiction of the English Courts.
